Welcome to Hysterion. These Terms of Service ("Terms") govern your use of the TroughT Controller hardware, the trought.hysterion.com web application, and all related services (collectively, the "Services") provided by Hysterion ("we," "us," or "our").

1. Description of Service

The TroughT Controller is an IoT water level monitoring and pump control system designed for agricultural, ranching, and industrial applications. It provides remote telemetry and automated control via cellular connectivity.

2. No Life Safety or Mission Critical Guarantees

CRITICAL NOTICE: The Services are provided as a convenience and monitoring tool. They are NOT intended to replace physical inspections, human oversight, or primary life-safety systems.

• Livestock & Agriculture: You acknowledge that cellular networks, cloud infrastructure, battery systems, and electronic sensors are subject to failure, outages, and environmental interference.
• Liability Waiver: Hysterion shall not be held liable for any loss of livestock, crop failure, property damage, water loss, or financial damages resulting from missed alerts, false readings, pump failures, or system downtime. You are solely responsible for ensuring the health and safety of your livestock and property.

3. Subscription and Billing

Certain features of the Services require an active SaaS subscription. Subscriptions are billed automatically through our payment processor (Stripe). Failure to maintain an active subscription will result in the suspension of cellular data access and cloud dashboard access. You may cancel your subscription at any time via the "Manage Billing" portal on your dashboard.

4. User Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. Hysterion is not responsible for any losses arising from the unauthorized use of your account.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HYSTERION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
